Terms of Service (StepZeno for iPhone)

1. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) and legally able to enter into these Terms. If you use StepZeno on behalf of an organisation, you confirm you have authority to bind that organisation.

2. App Purpose and Medical Disclaimer

StepZeno is a general fitness and wellness tracking app. It is not medical advice, a clinical tool, a diagnostic device, or a replacement for professional healthcare. Do not rely on StepZeno for emergency, clinical, or critical health decisions. Always consult a qualified health professional for medical concerns.

3. Accounts

If the app offers account sign-in, you are responsible for all activity under your account and for keeping your credentials secure. You agree to provide accurate information. You may use StepZeno without an account for basic local tracking features.

4. Subscriptions and In-App Purchases

• PRO features may require a paid subscription purchased through the Apple App Store.
• All purchases are processed by Apple via StoreKit. Apple's purchase terms and refund policy apply.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• To manage or cancel your subscription, go to Settings → [Your Name] → Subscriptions on your iPhone.
• Refund requests must be submitted to Apple directly via reportaproblem.apple.com.
• We do not process payments directly and cannot issue refunds on Apple's behalf.

5. License and Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use StepZeno on any iPhone or iOS device you own or control, for personal, non-commercial, lawful purposes.

You must not:

• Reverse engineer, decompile, or attempt to extract source code except where expressly permitted by law.
• Use the app to violate any law or third-party rights.
• Interfere with the app's security, integrity, or server infrastructure.
• Use automated tools, bots, or scripts to interact with the app.
• Distribute, sell, or sublicense the app or any portion of it.

6. Apple Health / HealthKit

StepZeno may request access to Apple Health (HealthKit) to read activity data such as step count, distance, and calories. This access is optional, requires your explicit permission via iOS, and can be revoked at any time in your iPhone's Health settings.

HealthKit data obtained by StepZeno will not be used for advertising, sold to third parties, or shared with anyone except as required to provide in-app functionality you request.

7. Intellectual Property

StepZeno — including its branding, design, software, and all content — is owned by us or our licensors and is protected by applicable intellectual property law. These Terms do not transfer any ownership or intellectual property rights to you.

8. Third-Party Services and Apple's Role

• StepZeno is made available through the Apple App Store. Your use of the App Store is governed by Apple's own terms.
• Apple has no obligation to furnish maintenance or support for StepZeno.
• In the event of any failure by StepZeno to conform to applicable warranties, you may notify Apple, and Apple may refund your purchase price (if any). Apple has no further warranty obligation.
• Apple is not responsible for addressing any claims relating to StepZeno or its use, including product liability, consumer protection, or intellectual property claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you.

9. Service Changes and Availability

We may modify, suspend, or discontinue features at any time, with or without notice. We may release updates, bug fixes, and feature changes to improve safety and performance. We do not guarantee uninterrupted access to the app or any feature.

10. Termination

We may suspend or terminate your access if you violate these Terms or for legal or security reasons. You may stop using StepZeno and delete it from your device at any time. Sections relating to intellectual property, disclaimers, liability, and governing law survive termination.

11. Disclaimers

StepZeno is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by applicable law. We do not warrant that the app will be error-free, uninterrupted, or that activity data will be perfectly accurate.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data or profits arising from your use of StepZeno. Our total liability to you is limited to the amount you paid for the app or subscription in the 12 months preceding the claim, or GBP/USD/EUR 50 if no payment was made.

13. Indemnity

You agree to indemnify and hold harmless StepZeno, DomCreator, and their affiliates from any claims, losses, or damages (including legal fees) arising from your misuse of StepZeno or your breach of these Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules, unless mandatory local consumer protection law requires otherwise in your jurisdiction. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, subject to any mandatory local consumer rights you may hold.

15. Changes to These Terms

We may update these Terms at any time. Continued use of StepZeno after an update constitutes your acceptance of the revised Terms. We will update the "Last Updated" date above when changes are made.
